CANCELLATION AND REFUND If the Student cancels a prepaid session at least 24 hours before the scheduled time, they will be entitled to a refund or may apply the pre-payment to a future session. In case the Tutor cancels a session for any reason and at any time before the session starts, the Tutor agrees to refund the Student any pre-payment for that session or to apply that payment to a future session that the Tutor and Student mutually agree upon. LATE ARRIVAL AND CHANGE OF SCHEDULE The Tutor can cancel lessons by providing at least 24 hours' notice to the Client/Student. If the Tutor cancels a session without giving sufficient notice, the Tutor will reschedule the appointment at a mutually agreed time, or the Client/Student will be refunded with a missed lesson fee. The Client/Student can cancel sessions by giving at least 24 hours' prior notice to the Tutor, in which case a refund will be given. If the Student does not attend a session without providing sufficient notice, no refund will be given. If the Tutor arrives late, the lost time will be made up by extending the lesson for the same duration mutually agreed upon by both parties. The Tutor will wait for 15 minutes from the scheduled start time before considering the session canceled without sufficient prior notice, and the CANCELLATION AND REFUND policy will apply. If the Student who arrives late, they will only be tutored for the remaining scheduled session time,, and no prolonged sessions will be allowed. Fees are determined based on the scheduled time agreed upon by the Tutor and Student. Late arrival or early termination of a session by the Student will not result in an adjustment to the fees. OBLIGATIONS OF THE STUDENT The Student undertakes to assist the Tutor in identifying problem areas in which the Student needs specific tutoring. The Student agrees to be prepared for every session by having all materials, utensils, homework, etc. ready and available prior to the session. NON-DISCLOSURE AGREEMENT ASL Pinnacle, the Tutor and Student agree to maintain the confidentiality of all information exchanged during the tutoring sessions. INTELLECTUAL PROPERTY RIGHTS ASL Pinnacle, the Tutor retains all rights, title, and interest in any teaching materials, notes, or other resources provided during the tutoring sessions. NO WARRANTIES While ASL Pinnacle endeavors to provide the best educational services possible, the Tutor and ASL Pinnacle makes no promises or warranties with regards to a Student’s performance as a result of any tutoring provided. In no event shall our obligations, expressed or implied, to any customer, exceed those obligations specifically noted herein. RELAXATION OF TERMS No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms. WHOLE AGREEMENT This agreement constitutes the entire understanding between the parties with regard to the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein. Any alteration to this agreement must be in writing and signed by both parties. Where the student is a legal minor, the parent/guardian shall enter into this tutoring contract on behalf of the student and shall accept and agree to all the terms and conditions contained herein on behalf of the student. COMMUNICATION CONSENT In order to facilitate effective communication and ensure the smooth running of our tutoring sessions, the Tutor may occasionally need to send you text messages. These messages may be related to schedule changes, cancellations, updates, and other pertinent information related to our tutoring arrangement.
